Preamble:
We, the Natives within the totality of the Eastern Islands of Dharma, including the territory under the immediate political control of said region, bearing in mind with our esteem rectitude that the division and establishment of a legal foundation to our great community would be beneficial to our wellbeing in addition to the equity and uniformity of the region's practiced law, do agree upon, invest and establish these fundamental articles of legislation as the solemn Constitution of the Eastern Islands of Dharma.
Defines:
(1) "The Head of State" as the regional founder of the incarnation of Eastern Islands of Dharma that is in existence at the time of reference; (2) "The Head of Government" as the elected WA Delegate, whose term has begun and not yet ended; (3) "Native" as a nation which takes up residence in a region without the intention of furthering the goals and aims of a foreign force;
Article I -- Our Inalienable Rights:
I. All are sovereign and have the right of self-determination in domestic policies, including Nation-States Issues, their Government Category and Statistics;
II. All have the Right to free speech, free press, free expression of religion, and free association on our forums, on our regional message board or any other entity that Dharma holds jurisdictional authority. These rights shall include a negative duty to (1) respect these rights for others, (2) express without overt intention to offend, vex, demean or defame other natives or particular cultures/races/religions/nationalities, (3) avoid expression that may lead to a serious threat to regional integrity, security or the failure of a defence mission (e.g., publicly declaring an invisible password or mission details), (4) further limits regarding these rights which may be applied by the Commander-In-Chief in regards to etiquette for soldiers (i.e., soldiers may be asked they cannot post on foreign Regional Civil Headquarters or send telegrams to foreign regional members during defense missions);
III. Participation in the Regional Government, Regional Forum, and Regional Military shall be voluntary. With the sole exception being the requirement of endorsing our delegate (or provisional delegate during times of emergency);
IV. The right to add an endorsement or withdraw an endorsement will remain a sovereign right of the WA member nation. With the sole exception being the requirement of endorsing our delegate (or provisional delegate during times of emergency);
V. All in the Eastern Islands of Dharma have the right to remove their endorsement of the delegate before any update of the game that will signify the conclusion of voting on a particular World Assembly resolution to which they are opposed to – so long as they clearly state on the Civil Headquarters that they are temporarily removing their endorsement of the delegate in opposition of a delegate’s voting decision;
VI. In all other game updates other than as specified by c.V, members of the World Assembly which are in the region have a duty and obligation to endorse the delegate to provide more influence for the delegate and thus security for the region;
VII. All Nations who are banned or ejected are entitled to an explanation from the Head of State or Head of Government for this decision;
VIII. Upon ejection or banning any Nation has the right to publically appeal the decision at the Supreme Court of Judicature, who shall produce a binding resolution, with the exception of cases where the Head of State invokes compelling security reasons as the reason behind the decision, in which case the Head of State must explain his reasoning in private to the Court;
IX. All natives are entitled to at-least two endorsements, and if these cannot be obtained organically the Head of State and Head of Government are required to provide them at the Natives request;
X. All have the right to appeal the Supreme Court of Judicature over a law or a decision enacted which may be have been unconstitutional or contrary to previously enacted legislation; if the Court rules against the law or decision it shall be stricken from the record;
XI. These Rights listed are not exhaustive. Other Rights may be defined and existing Rights may be expanded through further legislation. All Natives may propose further legislation and constitutional amendments, which shall become binding under the following conditions; (1) A regional vote is held upon the proposal, and at least two thirds of all votes registered in support, with a quorum requirement of 25% of regional members voting, (2) The Supreme Court of Judicature rules that the proposal legal under existing regional law, (3) The Head of State assents to sign the proposal into law;
Article II -- Our government:
I. Demands that the reigning World Assembly delegate be chosen at the discretion of all WA natives of the region via an election;
II. Encourages that all World Assembly delegates be natives of the Eastern Islands of Dharma;
III. Mandates that the length of a delegate’s term following an election shall be, unless for compelling security reasons or retirement of the delegate, equal to 170 days;
IV. Declares that the WA delegate shall serve as the head of Government of these Islands, for a term analogous with their term as delegate
V. Authorizes the delegate of the Eastern Islands of Dharma to eject any World Assembly member that is not endorsing them before an update at their own discretion, when the member is not protected by A.I-c.V;
VI. Further authorizes the Head of State to ban and eject any non-native of the Eastern Islands of Dharma for compelling security reasons which shall be left to the discretion of said founder;
VII. A period of one week shortly following the election shall facilitate the campaigning by members who are seeking appointment by the Head of Goverment for the following positions of cabinet: a. Minister of Immigration; b. Minister of Foreign Affairs; c. One Chief Justice of the Supreme Court of Judicature and two Associate Justices of the Supreme Court of Judicature; d. Minister of Culture;
VIII. The Ministry of Immigration a. Solemnly invested with the duty to manage recruitment, and assist new players in orientation and set recruitment goals; b. The Minister of Immigration, as the head of said Ministry, must be appointed by the current delegate;
IX. The Ministry of Foreign Affairs a. Solemnly invested with the duty to establishing and managing regional embassies, designing 'updates' and managing their distribution; b. While the crafting and signing of diplomatic treaties with other regions remain ultimately the sole right of the Head of State, the Minister is encouraged to seek the betterment of our relations with other regions and lay the framework under which these relations may be formalised; c. The Minister of Foreign Affairs, as the head of said Ministry, must be appointed by the current delegate;
X. The Supreme Court of Judicature a. Solemnly invested with the duty to arbitrate on decisions of interpretation of this constitution and to decide the legality of legislation and actions; b. Shall consist of one Supreme Justice and two Associate Justices; c. Following appointment by the current delegate, justices have tenure unless they CTE, cease to be a native, retire (perhaps to run for a governmental position) or have been a justice for three delegate terms. They will be replaced in those circumstances with a new Associate Justice as appointed by the Head of Government. If the Chief Justice is in need of replacement, their replacement will be selected from the current Associate Justices, and that void will be filled with a new nomination.
XI. The Ministry of Culture a. Solemnly invested with the duty to arrange fun regional activities and be a source of pure awesomeness when the region seems to lack such amenities; b. The Minister of Culture, as the head of said Ministry, must be appointed by the current delegate;
XII. a. No government official of the cabinet may hold two positions simultaneously, including the Head of State and the Head of Government; b. Any government position may be reassigned to some other native by discretion of the Head of Government, if the original civil servant has ceased-to-exist, is inactive for twenty-eight days or proven to be a non-native. Nativity shall be determined by the members of the Supreme Court of Judicature whose native status is not under question, or nativity shall be determined by the Head of State but only in the case of all of the Supreme Court of Judicature's members having questionable nativity. |
