Such an "endangerment" decision is necessary for the EPA to move ahead early next year with new emission standards for cars. EPA Administrator Lisa Jackson has said it could also mean large emitters such as power stations, cement kilns, crude-oil refineries and chemical plants would have to curb their greenhouse gas output.

The announcement would also give President Barack Obama and his climate envoy negotiating leverage at a global climate summit starting next week in Copenhagen, Denmark and increase pressure on Congress to pass a climate bill that would modify the price of polluting.

While environmentalists celebrate EPA's authority to regulate greenhouse gases, it has caused many large emitters to cringe at the potential costs of compliance.

According to a preliminary endangerment finding published in April, EPA scientists fear that man-made carbon dioxide and other greenhouse gases are contributing to a warming of the global climate. Senior EPA officials said in November the agency would likely make a final decision in December around the time of the summit.

Joe Mendelson, Global Warming Policy Director for National Wildlife Federation, said the endangerment decision, would happen at "absolutely the right time."

"With House legislation passed, a bipartisan Senate bill in the works, and strong EPA action a virtual certainty, the president goes to Copenhagen with a very strong hand to play," Mr. Mendelson said.

The EPA declaration would also ratchet up the pressure on U.S. lawmakers to pass legislation that analysts say would cut emissions in a more economically efficient way. Although the House has passed a climate bill, movement of similar legislation in the Senate has faced much more resistance and passage becomes more difficult in an election year.

The EPA's Ms. Jackson and President Obama's energy and climate czar Carol Browner have said they would prefer Congress to take action but are prepared to move ahead in the absence of lawmakers crafting their own law. (These unlawful idiots need to be fired. See how they just do as they please if they don't get their way?)

Industry experts say the Clean Air Act--under which the EPA is making its endangerment finding--was designed to regulate more regional and localized air pollution, and would be a much more blunt tool than Congress could craft. Critics, such as the U.S. Chamber of Commerce, say the endangerment declaration could spark a cascade of litigation and regulation that could harm the economy.

The EPA, meanwhile, says it would regulate in a sensible way. The agency has already moved forward on two rules that would guide regulation of greenhouse-gas emissions, primarily through a proposal to set the threshold level at 25,000 tons a year and requiring such large emitters to report their emissions.

If the EPA decided to move ahead with emission regulations for stationary sources such as utilities, new rules would likely be in place by 2012 and could set stringent emission standards to require firms to install the best available technology.

Two people close to the matter who met with White House officials earlier this week said one change between the proposed endangerment finding issued earlier this year and the final announcement expected next week is the inclusion of the potential cost to society of no emission regulations.

EPA Administrator Christie Whitman announced today that results from the Agency's air and drinking water monitoring near the World Trade Center and Pentagon disaster sites indicate that these vital resources are safe. Whitman also announced that EPA has been given up to $83 million from the Federal Emergency Management Agency (FEMA) to support EPA's involvement in cleanup activities and ongoing monitoring of environmental conditions in both the New York City and Washington metropolitan areas following last week's terrorist attacks on the World Trade Center and the Pentagon.

"We are very encouraged that the results from our monitoring of air quality and drinking water conditions in both New York and near the Pentagon show that the public in these areas is not being exposed to excessive levels of asbestos or other harmful substances," Whitman said. "Given the scope of the tragedy from last week, I am glad to reassure the people of New York and Washington, D.C. that their air is safe to breath and their water is safe to drink," she added.

In the aftermath of last Tuesday's attacks, EPA has worked closely with state, federal and local authorities to provide expertise on cleanup methods for hazardous materials, as well as to detect whether any contaminants are found in ambient air quality monitoring, sampling of drinking water sources and sampling of runoff near the disaster sites.

At the request of FEMA, EPA has been involved in the cleanup and site monitoring efforts, working closely with the U.S. Coast Guard, the Centers for Disease Control (CDC), the Occupational Safety and Health Administration (OSHA) and state and local organizations.

EPA has conducted repeated monitoring of ambient air at the site of the World Trade Center and in the general Wall Street district of Manhattan, as well as in Brooklyn. The Agency is planning to perform air monitoring in the surrounding New York metropolitan area. EPA has established 10 continuous (stationary) air monitoring stations near the WTC site. Thus far, from 50 air samples taken, the vast majority of results are either non-detectable or below established levels of concern for asbestos, lead and volatile organic compounds. The highest levels of asbestos have been detected within one-half block of ground zero, where rescuers have been provided with appropriate protective equipment.

In lower Manhattan, the City of New York has also been involved in efforts to clean anything coated with debris dust resulting from Tuesday's destruction. This involves spraying water over buildings, streets and sidewalks to wash the accumulated dust off the building and eliminate the possibility that materials would become airborne. To complement this clean up effort, EPA has performed 62 dust sample analyses for the presence of asbestos and other substances. Most dust samples fall below EPA's definition of "asbestos containing material" (one percent asbestos). Where samples have shown greater than one percent asbestos, EPA has operated its 10 High Efficiency Particulate Arresting, HEPA, vacuum trucks to clean the area and then resample. EPA also used the 10 HEPA vac trucks to clean streets and sidewalks in the Financial District in preparation for Monday's return to business. The Agency plans to use HEPA vac trucks to clean the lobbies of the five federal buildings near the World Trade Center site, and to clean the streets outside of New York's City Hall.

Drinking water in Manhattan was tested at 13 sampling points, in addition to one test at the Newtown Sewage Treatment plant and pump station. Initial results of this drinking water sampling show that levels of asbestos are well below EPA's levels of concern.

While FEMA has provided EPA with a Total Project Ceiling cost of slightly more than $83 million for the Agency's cleanup efforts in New York City and in at the Pentagon site, EPA currently is working with emergency funding of $23.7 million. If costs exceed this level, FEMA will authorize EPA to tap additional funding in increments of $15 million. As part of the additional funding to be provided by FEMA, EPA will be responsible for any hazardous waste disposal, general site safety and providing sanitation facilities for many of the search and rescue workers to wash the dust off following their shifts. EPA is coordinating with both the U.S. Air Force Center for Environmental Excellence and the U.S. Coast Guard to quickly implement these additional responsibilities to ensure that search and rescue personnel are provided with the maximum support and protection from hazardous materials that may be found during their mission.

At the Pentagon explosion site in Arlington Va., EPA has also been involved in a variety of monitoring of air and water quality. All ambient air monitoring results, both close to the crash site and in the general vicinity, have shown either no detection of asbestos or levels that fall well below the Agency's level of concern. Testing of runoff water from the disaster site does not show elevated levels of contaminants. Given the large numbers of Department of Defense (DOD) employees returning to work this week, EPA has worked closely with officials from DOD and from the Occupational Safety and Health Administration (OSHA) to evaluate air and drinking water quality and to be certain that the workplace environment will be safe.

While careful not to impede the search, rescue and cleanup efforts at either the World Trade Center or the Pentagon disaster sites, EPA's primary concern has been to ensure that rescue workers and the public are not being exposed to elevated levels of potentially hazardous contaminants in the dust and debris, especially where practical solutions are available to reduce exposure. EPA has assisted efforts to provide dust masks to rescue workers to minimize inhalation of dust. EPA also recommends that the blast site debris continue to be kept wet, which helps to significantly reduce the amount of airborne dust which can aggravate respiratory ailments such as asthma. On-site facilities are being made available for rescue workers to clean themselves, change their clothing and to have dust-laden clothes cleaned separately from normal household wash.


NOTE: Whitman is a proponent of Global Warming.(See "The Price of Loyalty" pg 172 where she is quoted as saying, "There's no question but that global warming is a real phenomenon that is occurring".)

Six Republican congressmen from Georgia have signed onto an Atlanta-based organization's legal challenge of a federal announcement that could lead to government regulation of greenhouse gas emissions.

The Southeastern Legal Foundation filed a petition last week calling on the Environmental Protection Agency to reconsider its Dec. 7 "endangerment finding" declaring carbon dioxide and other gases linked to global warming a threat to public health and the environment.

The petition argues that news of a conspiracy within the scientific community to hide evidence that calls into question manmade impacts on global warming has emerged since the closing of public comment on the EPA filing.

According to widespread media reports, e-mails stolen from the climate unit at the University of East Anglia in Great Britain appeared to show some of the world's leading scientists discussing how to shield data from the public.

"The scientific basis for the EPA endangerment finding is flawed, based on questionable and potentially fraudulent data, and certainly does not rise to the level of certainty necessary to upend the American economy, toss millions out of work, and which promises little or no climate change benefit over the next half-century," said Shannon Goessling, the group's executive director and chief legal counsel. "Using the Clean Air Act as a weapon and a shield does not justify the bigger agenda of command-and-control."

The foundation also criticized the EPA finding as an attempt to bypass Congress by imposing costly regulation of greenhouse gases administratively.

The fate of pending legislation to regulate carbon dioxide emissions through a cap-and-trade system is far from certain.

"The goal is to compel the federal government to follow the laws as enacted by Congress and to pursue legitimate public policy based on legitimate scientific data," Goessling said. "The American people deserve no less, and the U.S. Constitution mandates it."

Joining the foundation as plaintiffs are Republican U.S. Reps. Paul Broun of Athens, Nathan Deal of Gainesville, Phil Gingrey of Marietta, John Linder of Duluth, Tom Price of Roswell and Lynn Westmoreland of Grantville.

Endangerment Finding: The Administrator finds that the current and projected concentrations of the six key well-mixed greenhouse gases--carbon dioxide (CO2), methane (CH4), nitrous oxide (N2O), hydrofluorocarbons (HFCs), perfluorocarbons (PFCs), and sulfur hexafluoride (SF6)--in the atmosphere threaten the public health and welfare of current and future generations.

Cause or Contribute Finding: The Administrator finds that the combined emissions of these well-mixed greenhouse gases from new motor vehicles and new motor vehicle engines contribute to the greenhouse gas pollution which threatens public health and welfare.

These findings do not themselves impose any requirements on industry or other entities.  However, this action is a prerequisite to finalizing the EPA’s proposed greenhouse gas emission standards for light-duty vehicles, which were jointly proposed by EPA and the Department of Transportation’s National Highway Safety Administration on September 15, 2009. 

Background

On April 2, 2007, in Massachusetts v. EPA, 549 U.S. 497 (2007), the Supreme Court found that greenhouse gases are air pollutants covered by the Clean Air Act.  The Court held that the Administrator must determine whether or not emissions of greenhouse gases from new motor vehicles cause or contribute to air pollution which may reasonably be anticipated to endanger public health or welfare, or whether the science is too uncertain to make a reasoned decision.  In making these decisions, the Administrator is required to follow the language of section 202(a) of the Clean Air Act.  The Supreme Court decision resulted from a petition for rulemaking under section 202(a) filed by more than a dozen environmental, renewable energy, and other organizations.

On April 17, 2009, the Administrator signed proposed endangerment and cause or contribute findings for greenhouse gases under Section 202(a) of the Clean Air Act.  EPA held a 60-day public comment period, which ended June 23, 2009, and received over 380,000 public comments.  These included both written comments as well as testimony at two public hearings in Arlington, Virginia and Seattle, Washington.  EPA carefully reviewed, considered, and incorporated public comments and has now issued these final Findings.

IMO, this shows a concerted effort by a few ROGUE STATE GOVERNMENTS, with the help of their ridiculous environmental nuts, manipulating things so they could engage in carbon trading and decide for the rest of us. THIS IS UNACCEPTABLE!

Abandoning all loyalty to the democratic processes this nation holds dear, President Obama has made the decision that getting energy tax legislation through Congress with the approval of the American people is just too much of a pain to bother with. Instead he will have the EPA declare as early as next week that CO2 is a dangerous global warming gas and will start regulating its emissions immediately.

Obama’s promise to open up vast stretches of ocean on the East Coast and Gulf of Mexico to energy exploration is simply a ruse to soften up the public for soon to be announced draconian regulations.

WASHINGTON, D.C. - U.S. Sen. Lisa Murkowski, R-Alaska, today announced her intention to file a disapproval resolution to stop the Environmental Protection Agency (EPA) from regulating greenhouse gas emissions under the Clean Air Act. Murkowski's resolution comes in the wake of the agency's recent endangerment finding, which will result in damaging new regulations that endanger America's economy.

"I remain committed to reducing emissions through a policy that will protect our environment and strengthen our economy, but EPA's backdoor climate regulations achieve neither of those goals," Murkowski said. "EPA regulation must be taken off the table so that we can focus on more responsible approaches to dealing with global climate change."

While the administration claims the endangerment finding is merely an affirmation of the science behind global climate change, Murkowski said that aspect is just the tip of the iceberg.

"The EPA administrator's move has thrown open the door to expensive and intrusive government regulation - as far from a market-based solution as we can possibly imagine," Murkowski said. "The endangerment finding is aptly named. It endangers jobs, it endangers economic growth, and it endangers American competitiveness, while setting the stage for backdoor bureaucratic intrusion into the lives of Americans on an unprecedented scale.

The administration introduced the endangerment finding the week before the president travelled to Copenhagen, instead of working with Congress to find a bipartisan solution to the nation's climate and energy challenges. Congress should be given the time it needs to draft, debate and ultimately pass climate legislation.

"The EPA has taken these actions despite the fact that Congress is continuing to work on climate legislation. I find that highly counter-productive, especially as our nation struggles to regain its economic footing," Murkowski said. "The endangerment finding must be stopped so that Congress can pass responsible legislation that is sound on its own merits, and not merely a defense against the threat of damaging regulations."

Murkowski warned those who believe EPA action will prod Congress to act faster that such a strategy is likely to fail and carry with it unintended consequences.

"Make no mistake - Congress is being threatened in a misguided attempt to move a climate bill forward," Murkowski said. "But this strategy is highly flawed because it assumes Congress will pass economically damaging legislation in order to stave off economically damaging regulations. That's a false choice and it should be rejected outright."

Instead of threatening Congress, Murkowski said the administration would be better served by seeking a constructive role in policy formulation.

"This administration should be able to work with this Congress to pass needed, common-sense, and transparent reforms to our energy and environmental policies," Murkowski said. "Until the administration stops playing Russian roulette with the economy and decides to reach across the aisle, however, it will be difficult to do anything but oppose the irresponsible decisions that are being made."

Murkowski will file her disapproval resolution pursuant to the provisions of the Congressional Review Act (CRA). Sen. Don Nickles, R-Okla., and Sen. Harry Reid, D-NV, were the principal sponsors of the CRA, incorporated into the Contract with America Advancement Act of 1996, and signed into law by President Bill Clinton.

Upon introduction, a disapproval resolution is referred to the committee of jurisdiction, which in this case will be the Senate Committee on Environment and Public Works. If the committee does not favorably report the resolution within 20 calendar days, it may be discharged upon petition by 30 Senators. Once a disapproval resolution is placed on the Senate calendar, it is then subject to expedited consideration on the Senate floor, and not subject to filibuster.

So, despite the Congress not approving the Carbon tax related bills, the EPA, Obama and the Supreme Court did an end run around Congress and is implementing this. Isn't that interesting?

Also, it matters not what the people think. These guys just do as they please! They don't follow the rules, they make them!
