Two years after temporarily halting foreclosure evictions to prevent innocent renters from being put on the street, Cook County Sheriff Tom Dart said he is halting evictions ordered by some leading lenders after learning some of their employees had signed off without even reading foreclosure documents.

Dart, who is preparing to run for mayor of Chicago, said there are about 500 evictions he could carry out now and perhaps an additional 1,000 within days but that he won't until he receives an affidavit from each of the banks asserting all their evictions are legitimate.

"Before I am asked to put more families out on the streets I am going to require the banks to tell me one basic thing: that it is all legal, that they have done their job and they are not asking me again to do something that's horribly unjust and in some cases may even be illegal," Dart said at a news conference.

Dart said his deputies will simply serve notices to residents of an eviction order until the end of this week. He said if he doesn't receive the requested affidavits by Monday, he will not enforce orders from Bank of America, JP Morgan Chase and GMAC/Ally Financial.

Dart's announcement comes a day after Bank of America announced plans to resume seizing more than 100,000 homes in 23 states, saying it had the legal right to do so despite accusations that documents used in the process were flawed.


I agree this needs to be done, and more States should be doing the same. I just hope he is not only doing this because he is running for Mayor, but that because it is the right thing to do.

Attorneys general in all 50 states and the District of Columbia are jointly investigating whether mortgage companies have violated state laws. In Maryland, an emergency measure that the state's highest court approved this week outlines how state judges can review foreclosures and stop them if documents are invalid.

The Obama administration's top housing official said Wednesday that lenders are within their rights to resume foreclosures. But he cautioned that they could face federal fines if found to have broken the law.

The warning was largely directed at Bank of America Corp. and Ally Financial Inc.'s GMAC Mortgage unit, two big lenders who are resuming foreclosures after halting them temporarily to review documents. Both lenders faced allegations that employees signed but didn't read foreclosure documents that may have contained errors. The companies say they're fixing the problems.

In New York state, attorneys already have an obligation to ensure that the documents they present to the court are valid. But New York Chief Judge Jonathan Lippman said having them sign something affirming that all papers got a proper review will hold them accountable like never before.

"We want to make sure that everyone is focusing like a laser on these particular types of proceedings," he said. "It puts them on notice. That's what this is all about. We all have to make doubly sure that we are doing what we should be doing in the first place."

The rule requiring a signed affirmation applies to both new cases and the 78,000 foreclosure actions already under way in New York courts.

Lawyers handling pending foreclosures will probably need to go back to their clients and verify that all proper steps were followed, Lippman said. The form created by the court requires the lawyers to identify the bank employee who affirmed that the records were accurate and disclose the date the conversation occurred.

Separately, New York Gov. David Paterson signed a new law Wednesday that will force banks to pay the legal fees of homeowners who successfully defend themselves against a foreclosure.

The idea, sponsors of the legislation said, is to give lawyers an incentive to take on cash-strapped clients who have a good case that a foreclosure is invalid, but can't afford an attorney.

"We cannot let people with valid defenses to foreclosure lose their homes merely for lack of legal representation," said Assemblyman Rory Lancman, a Queens Democrat who sponsored the legislation.

Ray Brescia, an Albany Law School professor who has tracked the mortgage crisis, said New York's new rule requiring lawyers to verify the accuracy of the foreclosure documents they file with the courts could be a model for other states.

"It really raises the ante on lawyers in a way that I've never seen before," Brescia said. If they don't comply, lawyers could face financial penalties, could be suspended from practicing or could be disbarred in extreme cases, he said.

Some New York judges have complained loudly about rampant errors of varying severity in legal filings by banks seeking to foreclose on record numbers of homeowners. In some cases, documents that were supposed to have been given an individualized review were signed by bank employees who never read them or checked them for errors.

Lippman said he was convinced the courts were seeing "systemic structural failings" in the foreclosure process, and he said judges and lawyers have a responsibility not to close their eyes to paperwork errors – even if they seem minor.

"You are talking about tremendous consequences. You are talking about taking people's homes," he said. "Those papers have to be accurate. They have to be credible."

In Washington, Housing and Urban Development Secretary Shaun Donovan said Bank of America and GMAC made "a business decision" to resume foreclosures.

Donovan said the government has found no evidence that the entire system used to handle foreclosures is flawed. Several federal agencies, including his department, bank regulators and the Federal Trade Commission, have authority to penalize mortgage companies if they're found to have violated the law.

The housing secretary discussed the foreclosure document mess earlier in the day with officials from 11 federal agencies that are reviewing the issue. He said the government is also in contact with the state attorneys general.

A federal law enforcement official told The Associated Press on Tuesday that the FBI is trying to determine whether the financial industry broke criminal laws in the mortgage foreclosure crisis.

In a related inquiry, Donovan said the Federal Housing Administration has found disparities in how five major lenders have responded to distressed homeowners. He said the FHA reached that conclusion after a four-month review. He declined to name the lenders.

The government has authority to fine lenders that fail to comply with guidelines of the FHA, which guarantees some home loans.

Some lawmakers have called for a national halt to foreclosures. The Obama administration opposes such a move, saying doing so could hurt the housing market by making it harder for buyers of foreclosed homes to complete their transactions.

In an interview earlier this week, Rep. Barney Frank, D-Mass., the chairman of the House Financial Services Committee, said he also didn't support a nationwide foreclosure freeze. (Barney Frank needs to be kicked out of Congress. He is nothing but a YES man for the Globalist/Bankers. He has gone along with them at every turn, and needs to be punished politically by losing his seat and powerful position.)

"It never seemed to me that the great majority of these foreclosures were going to be invalid," he said. Frank said, though, that lawmakers should work next year to enact tighter regulations over the industry.

This is interesting because it brings some accountability to lawyers who are handling these foreclosures. MERS tried to claim it was violated of Due Process. The court found that since MERS suffered no injury, it did not qualify for protection under the Due Process Clause of either the United States or the Kansas Constitution!

Szymoniak, 63, is among six whistle-blowers who will pocket $46.5-million as part of a $25-billion national foreclosure settlement that state and federal officials reached in February with five banks, including Bank of America Corp. and JPMorgan Chase & Co., according to the U.S. Justice Department.

“When they did this to her, they picked the wrong person at the wrong time in the wrong place,” Richard Harpootlian, Szymoniak’s attorney in two whistle-blower cases, said in an interview. “They stuck their hand into the beehive.”

Szymoniak’s examination, in which she relied on her experience as an insurance-fraud investigator, led to her claims against banks for submitting fraudulent documents to the federal government asserting that they owned loans insured by the Federal Housing Administration, she said.

The national foreclosure settlement with the five banks, which resolves claims of abusive foreclosure practices, provides mortgage relief to borrowers, pays $1.5-billion to those who lost their homes to foreclosure, and sets standards for how the banks service mortgage loans.

Whistle-Blowers’ Share

As part of the agreement, whistle-blower claims are being settled for about $228-million, according to court papers filed in federal court in Washington. A group of six whistle-blowers will receive $46.5-million out of that amount, said Alisa Finelli, a Justice Department spokeswoman.

Szymoniak’s foreclosure case began in July 2008 when Deutsche Bank AG, as trustee for a mortgage securitization trust, sued to seize her Palm Beach Gardens, Florida, home, which was once worth $1.3-million. The bank couldn’t prove it owned her loan and claimed it had lost the mortgage note, she said.

Like many homeowners, Szymoniak said she was surprised by the subprime mortgage crisis and its effect on the U.S. real- estate market. She stopped making mortgage payments in 2008 after a battle with cancer wiped out her savings and she cut back on work to care for her mother, who was sick, she said in an interview.

‘Pretty Obvious’

Szymoniak said she was first alerted to problems in the paperwork on her foreclosure when Deutsche Bank said it acquired her mortgage note in October 2008, three months after the bank sued her over the loan.

“So I began doing what I’ve done for years — go out and investigate,” she said. “It was pretty obvious to me that the paperwork was fraudulent.”

Her work quickly uncovered widespread document fraud in the mortgage industry, she said, and eventually led to the filing of her whistle-blower cases in 2010.

The whistle-blower claims resolved in the national settlement include a case filed in Atlanta in 2006 in which banks are accused of defrauding military veterans and the U.S. government.

The banks violated rules under a Department of Veterans Affairs program for refinancing mortgage loans by charging improper fees to veterans, according to the complaint. The banks hid those fees and obtained government guarantees on the loans, according to the complaint.

Veterans’ Settlement

The two whistle-blowers, Victor Bibby and Brian Donnelly, will split $11.7-million out of the $45-million JPMorgan agreed to pay to settle the veterans case, said Brandon Peak, a lawyer working on the case. Claims against other banks in the case are pending.

The settlement underscores the benefits provided to taxpayers from whistle-blowers and the incentives for those who expose fraud through so-called qui tam cases, Peak said.

“This is what qui tam actions are for — to incentivize people to come forward and expose fraud,” he said. “The taxpayers actually receive this money back that they never would have received absent these whistle-blowers.”

Szymoniak said her review of mortgage documents uncovered the practice known as robo-signing, in which bank officials and contractors signed tens of thousands of foreclosure documents at a time without verifying any of the information. The same people also used various job titles on the forms, Szymoniak said.

Widespread Practices

It took her “less than five days” to figure out that the practices were widespread.

Szymoniak decided to approach law-enforcement officials with her suspicions that taxpayers may have been defrauded as the fraudulent documents were submitted to the U.S. Department of Housing and Urban Development by banks seeking to collect on government-insured loans, she said.

Her discoveries also prompted her to hire Harpootlian, who had retained Szymoniak in the past as an expert witness in a lawsuit against the insurer American International Group Inc., to file her whistle-blower claims.

Szymoniak was also represented by Ken Suggs, another South Carolina-based plaintiffs’ lawyer and Reuben Guttman, a Washington-based attorney who specializes in whistle-blower litigation.

Most whistle-blower cases are brought by company insiders who uncover wrongdoing within their own corporations or a competitor’s, said Joel Hesch, a former Justice Department lawyer who is now a professor at Liberty University Law School in Virginia. A person doesn’t have to be an insider to file a false-claims case, said Hesch, who spent 16 years litigating whistle-blower cases on behalf of the government.

80% Rejected

The government turns down about 80% of whistle- blower cases it reviews as a required step in the litigation, Hesch said. If the government rejects the case, plaintiffs are free to press their claims on their own.

Szymoniak said she was prepared to do just that if the government failed to join her suit over mortgage-foreclosure practices.

Thomas Kelly, a spokesman for New York-based JPMorgan, declined to comment on the whistle-blower cases resolved as part the national foreclosure settlement. Shirley Norton, a spokeswoman for Charlotte, North Carolina-based Bank of America, didn’t return an e-mail seeking comment.

The three other lenders that agreed to the national settlement were Detroit-based Ally Financial Inc., San Francisco-based Wells Fargo & Co. and Citigroup Inc. Gina Proia, an Ally Financial spokeswoman, declined to comment. Wells Fargo spokeswoman Vickee Adams didn’t return an e-mail seeking comment.

‘No Systemic Issues’

Mark Rodgers, a Citigroup spokesman, also declined to comment on the claims. The New York-based bank has added resources to ensure foreclosures are processed correctly, he said in an e-mailed statement.

“The changes and safeguards implemented give Citigroup confidence that there are no systemic issues in its existing foreclosure processes,” he said.

Szymoniak said she’s unsure what she’ll do with the $18-million award. Deutsche Bank is proceeding with its foreclosure action against her home, she said.

“Even if I pay off the mortgage, I would own a house with no clear title, so I still couldn’t sell it,” she said.
